We are seeing more cases where the office staff of physicians are named in lawsuits. Although most cases involve NP’s and PA’s, non-medical staff has been named as well. Some of these defendants are not insured. Others are insured, however, the physician’s legal entity is named as well and vicarious liability is claimed. In other cases, all legal entities are named, including dormant corporations, and other entities established for billing purposes. Carriers may not cover the staff members or entities and in some circumstances, they may not offer a courtesy defense. Please check your policy, your legal entities and your coverage to ensure that you are properly protected. Remember that even if you are not personally liable, the assets of your business could be subject to exposure.
